We, BenQ America Corp. and its Affiliates (collectively “BenQ”, “we”, “our” or “us”) believe that it is important to protect your personal data you have provided to us. In this Privacy Policy, we will explain how we collect, process, and protect your personal data on BenQ websites, services, member center, and online stores that reference this Privacy Policy (together “BenQ Services”).

For purposes of this Privacy Policy, “Affiliate” means (i) BenQ Corporation, a Taiwanese company, (ii) any entity of which 50% or more of its outstanding shares directly or indirectly owned by BenQ Corporation, and (iii)any company with the name "BENQ" as a part of its trade name) who may, subject to your consent, contact you about products, services or other offerings that may be of interest to you.

What is personal data

Personal data means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, address, telephone number and date of birth. Information which cannot be linked to your real identity - such as favorite websites or number of users of a site - is not considered personal data.

What personal data BenQ collects from you

BenQ collects and stores the following types of personal data:

  • Data provided by you - BenQ may ask you to provide your e-mail address, name, mailing address, telephone number, identity document information (such as national identity registration card number), payment information, IP address, location information, personal description, and photo in Your Profile, content of reviews and communication with us which is associated with individually identifiable information. You can choose not to provide certain information, but then you might not be able to take advantage of many of BenQ Services.
  • Automatic information - BenQ web server automatically recognizes, collects, and/or stores information such as IP address/domain name combination, device information, your use and interaction of BenQ, and any referring sites, when your web browser or device accesses BenQ Services and other content served by BenQ. Like many websites, BenQ may use several technologies to obtain this type of information. Please see Cookies and other technologies.
  • Anonymous Aggregated Information - BenQ may also collect, aggregate, and maintain anonymous information about you, such as hobbies, interests, purchasing habits, music preferences, and the like. This data can then be used to tailor BenQ Services, including promotions, advertising, and communications to deliver a better experience for you.
  • Personal data BenQ receives from other sources - We might receive information about you from other sources, such as updated delivery and address information from our carriers. You may also direct or allow other third parties to share your personal data with BenQ for purposes such as login, activation of BenQ services, or sharing information about your participation in BenQ events.
BenQ’s use of personal data

We collect personal data from you for one or more of the following purposes mentioned below.

  • Purchase and delivery of products and services - To handle and fulfill orders or transactions between you or the entity that you represent and BenQ, deliver products and services, process payments.
  • Communication and customer services - To enable you to participate in BenQ events or online chats, provide warranty, or send important notices and promotional offers, reach out to you about your order or account, develop and test new services and features, answer your questions and process your requests, which means that we also use your personal data to respond to you when you contact us.
  • Advertising - To recommend features, products, and services that might be of interest to you, identify your preferences, invite you to join contests, lucky draws, or other BenQ event. BenQ will seek to obtain your consent at the time you register to join BenQ either by an "opt-out" or "opt-in" method or by other means (such as an e-mail request). Does BenQ share your personal data

BenQ will not share the personal data you provide with any other parties, except (a) with your consent, (b) as necessary to provide products, services or other offerings, (c) as may be required by law or court order, (d) to persons or companies with whom BenQ engages to carry out or provide support for the operations of the sites or BenQ Services, or (e) to exercise our legal rights and comply with our obligations under the laws, including law enforcement or other government agencies, in connection with a criminal investigation, fraud prevention, or other legal action or if BenQ reasonably believes it is necessary to do so to protect BenQ, its customers, or the public.

BenQ may transfer your personal data outside of your jurisdiction for any of the purposes set out in this Privacy Policy in accordance with all applicable laws. The recipients are required to safeguard any personal data they receive from BenQ and comply with the applicable laws under that jurisdiction.

BenQ works with third-party service providers to help us operate, provide, improve, understand, customize, support, and market BenQ Services, such as to provide delivery and other systems; conduct surveys and research for us; and assist with customer service. When we share information with third-party service providers in this capacity, we require them to use your personal in accordance with our instructions and terms.

Your Privacy Rights

You may exercise your rights as a data subject under applicable laws, including access, manage, delete your personal data, and make correction. We may also decline to grant your request where doing so is permitted by the law (such as when you request deletion of an account that is being investigated for security concerns). Other reasons your privacy request may be denied are if it jeopardizes the privacy of others, is frivolous or vexatious, or would be extremely impractical.

Security

BenQ takes appropriate measures to maintain the security of your personal data and in preventing unauthorized access to it through the use of appropriate technology and internal procedures. However, BenQ does not guarantee that unauthorized access will never occur.

BenQ stores personal data only for so long as necessary for purposes for which it was collected, including as described in this Privacy Policy or in our service-specific privacy statement, for other legitimate purposes, such as complying with legal obligations, enforcing and preventing violations of our terms of services (if applicable), or protecting or defending our rights, property and users or as required by law. The storage periods are determined on a case-by-case basis that depends on factors like the nature of the information, why it is collected and processed, relevant legal or operational retention needs, and legal obligations.

Cookies and other technologies

Examples of such technologies are cookies and web beacons. When you visit BenQ' websites or advertisements appearing thereon, or use one or more of the BenQ website services, or receive e-mails from BenQ we may use an industry-wide technology called "cookies" which stores certain information on your computer and which will allow us to customize your experience to better match your interests and preferences or to simply facilitate your signing in to use the services. BenQ may also itself use, or engage third parties to use, Web beacons for researching certain usage and activities on our Website. The information collected by BenQ or requested from third parties through these Web beacons is in an aggregate, non-individually identifiable form and is used to find out more about users including demographic information and usage patterns for more accurate reporting and to improve the effectiveness of our marketing. BenQ may also itself use, or engage third parties to use, pixel tags or other technology to research or track your usage activities with respect to e-mails from us.

Notice To/Regarding Children Under the Age of 13

BenQ is open only to individuals who are 13 years of age and older. Except as may be required by law, the website does not knowingly collect, maintain or disclose your personal data if you are under age of 13. BenQ believes that children using the Internet require special protection, and we urge parents or guardians to explain Internet safety to their children. Parents are urged to spend time online with their children to become familiar with the types of content available on the Internet. Control tools are available from online services and software manufacturers to help create a safer environment for children.

Changes to Privacy Policy

The terms of this Policy will govern the use and any information collected while it is in place. BenQ reserves the right to change this Policy at any time, so please re-visit this page as often as you wish. In case of any material change, we will change the "Last Update" date in this Privacy Policy and/or post a notice on the site. Changes to this Privacy Policy are effective as of the stated "Last Update" date and your continued use BenQ on or after the "Last Update" date will constitute acceptance of, and agreement to be bound by, those changes.

BenQ websites may contain URLs which direct you to a platform operated by other parties. You agree that your visit to such platform is solely based on your discretion and at your own risk. BenQ is not responsible for the privacy practices of websites operated by these other parties. You are advised to check on the applicable privacy policies of those websites to determine how they will handle any information they collect from you.

Your acceptance and use of the services provided by a third party or a BenQ Affiliate will be subject to terms and conditions as may be agreed between you and the third-party service provider or the Affiliate. The collection, use, and processing of personal data will be subject to the applicable privacy policy of the third-party service provider or the Affiliate. You agree that any queries or complaints relating to the services provided by the third-party service provider or the Affiliate shall be directed to the party named in the applicable privacy policy.

California Consumer Privacy Rights as to Personal Information Collected by BenQ America Corp.

As a California resident, in addition to the rights that you may have under BenQ’s Privacy Policy, you have certain rights with respect to your personal information that BenQ has collected, uses and may have disclosed.

Right to Know About Personal Information Collected by BenQ. Subject to BenQ’s receipt of a verifiable request, you have the right to request that BenQ discloses to you the following information that may have been collected by BenQ in the preceding 12 months from the date of your request:

  • The specific pieces of personal information BenQ has collected about you;
  • The categories of personal information BenQ has collected about you;
  • The categories of sources from which your personal information was collected;
  • The categories of personal information about you BenQ may have disclosed for a business purpose;
  • The categories of third parties to whom your personal information BenQ may have disclosed for a business purpose;
  • The business or commercial purpose for BenQ collecting your personal information.

BenQ does not sell your personal information. Nonetheless, please note that under California law you have the right to direct a business that does sell your personal information to third parties to stop the sale of that information

BenQ will deliver the personal information you request through the same means that the request was received.  BenQ is not required to provide your personal information to you more than twice in a 12-month period.

Right to Deletion of Personal Information Collected, Used, Disclosed or Sold. Subject to BenQ’s receipt of a verifiable request, you have the right to request that BenQ delete any of your personal information. However, there are a number of exceptions to this requirement under applicable law. BenQ may retain a consumer’s personal information if the retention is necessary to: (1) complete the transaction for which the personal information was collected; (2) provide a good or service requested by the consumer or reasonably anticipated by the business relationship; (3) perform under a contract with the consumer; (4) detect security incidents, or protect against malicious, deceptive, fraudulent or illegal activity (or prosecute those responsible); (5) debug to identify and repair errors; (6) comply with the California Electronic Communications Privacy Act; (7) use internally in ways aligned with the expectations of the consumer based on the consumer’s relationship with the business; (8) comply or fulfill a legal obligation; or (9) in a lawful manner that is compatible with the context in which the consumer who provided the information.

Submitting a Request Pertaining to Personal Information. In order for BenQ to be able process your request to delete or provide you details of your personal information, BenQ must be able to verify that you are the person making the request. Therefore, we will need to get some information from you before we can process your request.

Confirmation. Once we receive your request, we will send you a confirmation on how your request will be processed and may ask you for additional information that is needed to process your request. If you are (i) requesting to know specific pieces of personal information, or (ii) requesting that we delete your personal information, you will need to provide BenQ with a signed declaration, under penalty of perjury, that you are actually the person whose personal information is the subject of the request.

Requests Through Authorized Agents. You may make a request to know or a request to delete your personal information through an authorized agent. In order to make such a request, the agent must submit proof of your written permission to serve as your authorized agent and provide satisfactory verification of their own identity.
