BenQ AQCOLOR Reward Your Review Program

By entering the Event, participants (“you” or “Participant”) agree to be bound by these Terms and Conditions (the “Event Rules”).

Until June 30, 2024, Participants (“You or “Your” as applicable) may enroll in the BenQ AQCOLOR Reward Your Review Program (“Event”). To enter, You must complete the following step

1. Purchase one (1) eligible brand new BenQ Product (“Product”) from any BenQ authorized shops and vendors in the United States, create an account at the BenQ website to become a member of BenQ America Corp. (“BenQ”), log in to Your BenQ account, and submit Your screenshot of a review on the retail website you purchased from or other online platforms (see examples under Section 10 below). You need to also submit all additional required purchase information to become eligible for the reward, as follows.

2. Provide Your Product serial number, the platform You posted the review on, the screenshot of your review on that platform, the review URL (set as public with no login required to view), proof of Your purchase invoices or receipts, and the date of the review (collectively, an “Entry”).

3. The date of review must be within the period of November 11, 2023 to June 30, 2024, and the following criteria shall also need to be met:

    (1) The review must contain a minimum of five sentences and at least one video or one photo.

    (2) Test and use your product before reviewing it. Share your honest and genuine opinion.

    (3) The review must be Product related and formulated in an understandable way.

    (4) Be sure to review only the item itself. If you need any customer service or technical support, please visit support.benq.com.

    (5) Review, video, and photo cannot include any defamatory, obscene, vulgar, profane, repulsive, discriminatory, abusive, obscene, lewd, threatening or insulting or offensive words, phrases, images, or inferences.

4. Agree to the Event Terms and Conditions and await BenQ's review of your submission. If BenQ determines You meet all eligibility criteria, then you are entitled to the reward as further described under Sections 11 and 12 below.

5. Submitting reviews with the same serial number on different platforms is not allowed. For instance, you cannot use Amazon and personal Facebook page reviews to claim two submissions based on the same serial number.

6. If you purchase more than 1 valid Product on a single receipt, please submit the Product review URLs related to that single receipt or invoice, and claim a reward for each Product separately. In short, if you buy two items, you need to submit twice, with different review URLs linked to the same invoice.

7. Participants must be at least 18 years old. Void where prohibited or restricted by law.

8. The event is only available in the United States of America.

10. Online platforms for review posting include but are not limited to Adorama, Amazon, Best Buy, B&H, Newegg, Facebook, YouTube, and other similar social media sites.

11. BenQ will review all Entries based on the eligibility criteria set forth herein to determine reward recipients at the end of each month.  BenQ will send email notifications to each reward recipient to verify delivery or eligibility information. If a reward recipient does not respond to the email within five (5) business days or does not provide us with the required delivery and verification information, the reward shall be deemed forfeited.

12. Reward item (“Prize”): Starbucks US$20 eGift Card. Rewards are available while stocks last.

13. The event is open only to eligible private consumers and not businesses. BenQ affiliates, subsidiaries, manufacturers, business partners, distributors, wholesalers, resellers, retailers, or agency employees, and the immediate families of all those listed above are not eligible to participate in this Event.

14. BenQ retains the right to make adjustments to these terms without prior notice, subject to directions from a regulatory authority. BenQ may, at its discretion, disqualify participants who do not meet or violate these Terms and Conditions. 

You hereby represent and warrant that:

1. The information You have provided is accurate and true;

2. You have the full authority, capacity, power, and right to enroll in this Event, and make the required license grant, representation, and warranties under these Terms and Conditions;

3. All submissions must be original creations. You assume liability for copyright and trademark adherence.

3. You have obtained and will maintain all applicable approval, consent, permissions, licenses, and waivers necessary to grant the licenses stated above to BenQ and its subsidiaries; and

4. You have complied with all applicable laws when enrolling in this Event.

You shall defend, indemnify, and hold harmless BenQ, its affiliates, successors, assignees, directors, and agents from and against any and all liabilities, damages, judgments, costs, expenses, and fees (including reasonable attorney’s fees) resulting from any claims, investigations, litigation, or other legal or administrative action by third parties arising out of or relating to any actual or alleged breach by You of any representations, warranties, and undertakings in these Terms and Conditions.

You hereby acknowledge and agree that as a condition for any recipient to be awarded a Prize in connection with the Event, such recipient hereby grants BenQ the right to use the recipient’s personal information and the recipient’s name, image, and likeness for promotional purposes.

Further, by submitting the Entry, Participant herein irrevocably grants to BenQ and its agents a non-exclusive, royalty-free, perpetual, unrestricted, global license for all intellectual property rights to and/or related to the Entry, including but not limited to copyright, without any compensation other than participating in the Event and any prize and without any restrictions of any nature for BenQ to use in its commercial, marketing, and sales activities, in any media currently existing or created in the future. BenQ has the right to use or not use any of the photos at BenQ’s sole discretion. 

BenQ reserves the sole and discretionary right:

1. to determine, on a final and conclusive basis, whether a Participant has fulfilled Event requirements in good faith. For illustrative purposes without limiting any other terms, BenQ may disqualify Participants if a) Event enrolment or Product registration is incomplete, b) Event eligibility requirements such as applicable Product line or regional restrictions are not met, c) the provided documents are forged, fraudulent, or void, d) automated codes, scripts, plugins or other means were used to enter or complete Event enrolment, e) the Participant does not have the legal capacity to enroll in this Event or f) criminal or illegal acts are committed or allegedly committed in the process of enrolling in this Event.

2. to replace the Prize with items of similar value without prior notice; No substitutions, transfers, or cash equivalents are allowed in the Event, except by BenQ, which reserves the right to substitute the Prize with an item or service of comparable or greater value. Any taxes and any duties imposed on the Prize are the Participant’s sole responsibility.

3. to vary, delete, or add to any of these terms and conditions without prior notice.

BenQ is not liable and assumes no liability to any person for any loss, dissatisfaction, or damage arising from the Prize and uses thereof. Reward recipients shall not make any claims against BenQ.

BenQ disclaims all liability for any delays, loss, or failure in the delivery of the reward notification due to mechanical, technical, electronic, communications, telephone, computer, hardware, internet, or software errors, malfunctions, or failures of any kind. In such an eventuality, the reward recipient unconditionally waives his/her right to the Prize and any associated compensation.

Each Participant agrees that any personal information provided by them will be: (a) processed in accordance with the BenQ Privacy Policy, which is available at https://www.benq.com/en-us/policy/privacy-policy.html; and (b) used by Promoter and their respective agents and suppliers to administer the Event and to enable Promoter to publicize the Event, before and after, in any media.  By participating in this Event, Participant agrees to receive marketing material delivered by email from, or on behalf of, BenQ. Whenever a Participant receives an email from BenQ, such Participant will have the option of discontinuing the receipt of further emails.

Promoter’s Privacy Policy describes its practices concerning data that Participants provide or that we may collect about Participant arising out of or in relation to the Event, and Participant consents to BenQ’s use and disclosure of such data in compliance with the Privacy Policy.

TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAWS, BENQ SHALL NOT BE LIABLE TO YOU ON ACCOUNT OF ANY CLAIM (REGARDLESS OF THEORY OF LIABILITY WHETHER BASED UPON PRINCIPLES OF CONTRACT, WARRANTY, NEGLIGENCE OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, OR OTHERWISE) FOR ANY SPECIAL, CONSEQUENTIAL, RELIANCE, INDIRECT, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING BUT NOT LIMITED TO LOST PROFITS, REVENUE, GOODWILL OR COST OF REPLACEMENT.

Governing Law: this Agreement and any remedies related hereto will be exclusively governed and construed in accordance with the laws of the State of California, excluding any conflicts of legal provisions. The parties hereby expressly consent to the personal jurisdiction of the state and federal courts located in Orange County, California for any dispute arising from this Agreement and affirmatively waive any and all objections of venue and in-person jurisdiction over it by said courts as well as any entitlement to any other laws. The prevailing party shall be entitled to receive its reasonable attorneys’ fees incurred in connection with such proceedings or arbitration, in addition to any other relief it may be awarded.

If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, or unenforceable for any reason, such provision will be eliminated or limited to its minimal enforceable extent, while all remaining provisions of the Terms and Conditions will continue in full force and effect.

Any disputes hereunder will be adjudicated under the laws of the State of California and Applicants agree to submit to the jurisdiction of the courts in Orange County, California and specifically waive any rights to any other jurisdiction or venue. The prevailing party will be awarded attorney’s fees.
